Just in -- Cort Wrotnowski's (CT) case was denied late yesterday by Justice Ginsburg (now there's a surprise).  It was resubmitted to Justice Scalia, and then was taken for anthrax testing.  Leo Donofrio (NJ) is fighting mad about the delay caused by this detour and is asking for demonstrations in front of the Supreme Court building.

Donofrio's case will be discussed by the Justices on Friday, and says Obama is not eligible because he is not natural-born.  Wrotnowski's case is similar, except Donofrio says it is even better written and stronger than his own.  Donofrio believes the two must be heard together.

Update:  Cort Wrotnowski, (SCOTUS Docket No. 08A469), a day after facing the shock of his life when told by a SCOTUS clerk that his renewed application to Justice Scalia would be held back for 7 days due to anthrax screening, hand delivered 10 copies of his renewed application to the Security booth at SCOTUS this morning at 10:30 AM.
 

Cort was told by the Clerk’s office that the papers would "probably" be in the Clerk’s office by 2:00 PM.  Cort’s application, according to Supreme Court Rule 22.1, should be "transmitted promptly" to the Honorable Associate Justice Antonin Scalia.  Keep your eyes on that Docket to see if they will follow the Rules of Court.

One attorney, practicing in the federal courts, believes Leo Donofrio's (NJ) case is actually looking pretty solid -- read this article at http://federalistblog.us/2008/11/natural-born_citizen_

This article points out that John A. Bingham, the Framer of the 14th Amendment, defined natural born citizen as follows: "every human being born within the jurisdiction of the United States of parents not owing allegiance to any foreign sovereignty is, in the language of your Constitution itself, a natural born citizen."  Obama, whose father was a British subject, had dual nationalities at birth, and thus would not be considered a natural born citizen.  The definition above is only Bingham's opinion, but it is certainly on point.  There is not a clear definition of natural born citizen in the Constitution, so the issue is "ripe" for consideration by the Supreme Court of the United States (SCOTUS).  It would not be surprising if four of the justices vote to give Donofrio's case a full hearing.
  Here is an updated case that gives examples of the citizenship classification.  The case is Perkins v. ELG, 307 U.S. 325 (1939).  It expands and refers on the U.S. v. Wong Kim Ark's case definition of nationality (below).  But the key is this case gives examples of what a citizen of the US is and what a native-born citizen (or natural born citizen) of the US is.  Attached is the case with highlights.   Here is a chart of the facts and the Supreme Court's holding in the case.  The Supreme Court will have to consider Obama ineligible to be President based on the two cases.  The problem for Obama is that his father was a foreigner (Kenyan Citizen) and Obama will never be considered natural born (or native born) of this country.

There's now absolute proof that Obama and his Chicago political Mafia has been plotting this circumvention of the US Constitution, for which he has such disdain.  The Obama camp has been studying ways to change the Constitutional requirements for President for some time now.

Remember, Obama taught courses in constitutional law at the University of Chicago as a "senior lecturer."  He KNOWS, and the DNC KNOWS, that Obama does not meet the standards of Section 1 of Article II of the US Constitution.

Are you afraid that if you were even to raise the subject with your friends that they will think you wear a tinfoil hat, because Factcheck.org, the final arbiter of truth in the universe, said so?

Are you with the news media, and after spending so much money to get Barack Obama elected, you'd hate to ruin your investment?

Are you a talk radio host who thinks that if you say the burden of proof needed to demonstrate one is eligible to be Commander in Chief should be at least as high as, oh, say, the level to be eligible for Hawaiian homestead status (see 1.F. below), that you'd be forced to give equal time to someone who disagrees?

Are you a conservative, libertarian, or any conscientious constitutionalist from any ideological side of life, who's convinced something's not right, but you're afraid your reputation might be tarnished because, after all, this could be one big Saul-Alinsky-style set-up, and the joke would be on you?

Fear not!  Joe the Farmer has prepared an outline showing that no matter how this issue is ultimately resolved, you have legitimate concerns, and that Barack Obama should, simply out of respect for the nation he was elected to lead, disclose the sealed vault copy of his birth certificate.

Given the circumstances, if Barack Obama respected this nation, he would prove it by the simplest and easiest of gestures - unless, of course, all this talk about change and hope was just a bunch of bull, and he's just "another politician."

A conservative activist is expressing alarm over president-elect Barack Obama's plan to expand a Clinton-era executive order that provides special protections for federal employees based on their sexual behavior.

 

 

The Obama-Biden transition team has included both "sexual orientation" and "gender identity" in its non-discrimination policy for applicants for employment in the incoming Obama administration. President Bush, much to the chagrin of many social conservatives, did not overturn Bill Clinton's executive order prohibiting discrimination on the basis of sexual orientation. However, the Clinton order does not address so-called gender identity.
 
Word of Obama's planned executive order has excited his allies on the left. Christopher Anders, senior legislative counsel with the American Civil Liberties Union, says "president-elect Obama and vice president-elect Biden, by explicitly rejecting the bigotry and intolerance of the past, are committing that gay, lesbian, and transgender professionals can serve in government without fear of discrimination."
 
Peter LaBarbera, president of Americans for Truth About Homosexuality, says Obama's new non-discrimination policy will be an "open door" for gender-confused and cross-dressing federal employees.
 
"What's the Obama administration going to do to protect women in federal restrooms?" the activist asks. "Since men [wearing] dresses apparently are going to be protected under gender-identity provisions, what about the women in the restrooms in the White House and other federal buildings? What's going to be done to protect their rights?"
 
LaBarbera even wonders if there is going to have to be a new federal outlay for the building of new "gender-free, transgender restrooms."
 
The president-elect has been a supporter of a version of the Employment Non-Discrimination Act (ENDA) that offers special protections for transgender employees.

 

 

Supreme Court Justice David Souter’s Clerk informed Philip J. Berg, the lawyer who brought the case against Obama, that his petition for an injunction to stay the November 4th election was denied, but the Clerk also required the defendants to respond to the Writ of Certiorari (which requires the concurrence of four Justices) by December 1.  At that time, Mr. Obama must present to the Court an authentic birth certificate, after which Mr. Berg will respond.

If Obama fails to do that, it is sure to inspire the skepticism of the Justices, who are unaccustomed to being defied.  They will have to decide what to do about a president-elect who refuses to prove his natural-born citizenship.

"I can see a unanimous Court (en banc) decertifying the election if Obama refuses to produce his birth certificate," says Raymond S. Kraft, an attorney and writer.  "They cannot do otherwise without abandoning all credibility as guardians of the Constitution.  Even the most liberal justices, however loathe they may to do this, still consider themselves guardians of the Constitution.  The Court is very jealous of its power -- even over presidents, even over presidents-elect."

Also remember that on December 13, the Electoral College meets to casts its votes.  If it has been determined that Mr. Obama is ineligible to become President of the United States, the Electors will be duty-bound to honor the Constitution.

A pro-family advocate is outraged that a California public school teacher would pass out homosexual pledge cards to her kindergarten students.

 

The pledge cards were produced by the Gay, Lesbian and Straight Education Network, or GLSEN, and featured oaths that students would not use "anti-lesbian, gay, bisexual and transgender language or slurs," that students would intervene on behalf of homosexual students when possible, and that they would actively support safer schools efforts.
 
Tara Miller is a kindergarten teacher at Faith Ringgold School of Arts and Science in Hayward, California. She passed out the pledge cards to her students, which she then asked them to sign. Peter LaBarbera, the president of Americans for Truth about Homosexuality, is outraged at Miller's actions.
 
"First of all, why is homosexuality as an issue being raised at all in kindergarten? These are students who don't even know what sex is yet, and this teacher is talking to them about homosexuality," he contends. "This is an abuse of these students' minds, and it's just wrong."

 
According to a report on FoxNews.com, one parent was angry when she found her child's signature on the pledge card. LaBarbera believes this instance highlights the real agenda of the homosexual movement.
 
"This is just bizarre, and it shows how the teachers with their radical sexual agenda want to start early to reprogram these kids' minds. They want to undermine the faith teachings that the kids have at home; this is part of a plan," he suggests. "To me, this is like Hitler with Nazi Germany and the Soviets wanting to get to the youth and change the kids by getting to them at a very young age."
 
In the same report on FoxNews.com, a spokesperson for the school agreed that the pledge was inappropriate for the kindergarten students and said that the pledges were meant for middle school and high school students.

 

 

WASHINGTON - Barack Obama's aunt, a Kenyan woman who has been living in public housing in Boston, is in the United States illegally after an immigration judge rejected her request for asylum four years ago, The Associated Press has learned.

 

Zeituni Onyango, 56, referred to as "Aunti Zeituni" in Obama's memoir, was instructed to leave the United States by a U.S. immigration judge who denied her asylum request, a person familiar with the matter told the AP late Friday. This person spoke on condition of anonymity because no one was authorized to discuss Onyango's case.

Information about the deportation case was disclosed and confirmed by two separate sources, one of them a federal law enforcement official. The information they made available is known to officials in the federal government, but the AP could not establish whether anyone at a political level in the Bush administration or in the McCain campaign had been involved in its release.

Onyango's refusal to leave the country would represent an administrative, non-criminal violation of U.S. immigration law, meaning such cases are handled outside the criminal court system. Estimates vary, but many experts believe there are more than 10 million such immigrants in the United States.

The AP could not reach Onyango immediately for comment. No one answered the telephone number listed in her name late Friday. It was unclear why her request for asylum was rejected in 2004. The Obama campaign declined to comment late Friday night.

Onyango is not a relative whom Obama has discussed in campaign appearances and, unlike Obama's father and grandmother, is not someone who has been part of the public discussion about his personal life.

A spokeswoman for U.S. Immigrations and Customs Enforcement, Kelly Nantel, said the government does not comment on an individual's citizenship status or immigration case.

Onyango's case - coming to light just days before the presidential election - led to an unusual nationwide directive within Immigrations and Customs Enforcement requiring any deportations prior to Tuesday's election to be approved at least at the level of ICE regional directors, the U.S. law enforcement official told the AP.

The unusual directive suggests that the Bush administration is sensitive to the political implications of Onyango's case coming to light so close to the election.

Kenya is in eastern Africa between Somalia and Tanzania. The country has been fractured in violence in recent years, including a period of two months of bloodshed after December 2007 that killed 1,500 people.

The disclosure about Onyango came just one day after Obama's presidential campaign confirmed to the Times of London that Onyango, who has lived in public housing in South Boston for five years, was Obama's half aunt on his father's side.

It was not immediately clear how Onyango might have qualified for public housing with a standing deportation order.

Bill Ayers is Obama's neighbor, friend, business associate, employer and editor.  He wrote his manifesto, entitled "Prairie Fire," in 1974.  In his book, which is extremely difficult to obtain, Ayers calls for socialism in America and stopping aid to Israel.  It's full title is, "Prairie Fire:  The politics of revolutionary anti-imperialism." (The page at the link is outstanding and shocking.)

In his manifesto, Ayers writes, "We are a guerilla organization.  We are communist men and women, underground in the United States for more than four years" and "We need a revolutionary communist party in order to lead the struggle, give coherence and direction to the fight, seize power and build the new society" and "Our intention is to disrupt the empire, to incapacitate it, to put pressure on the cracks, to make it hard to carry out its bloody functioning against the people of the world, to join the world struggle, to attack from the inside."

Ayers manifesto is dedicated to 100 radicals, among them is Sirhan Sirhan, the man who assassinated Robert Kennedy.

Why would Barack Obama associate so closely with a man who supports Robert F. Kennedy's murderer, seeing him as a mere "political prisoner".  That's a view so far out into fringe territory that it could give a Berkeley radical pause.

Obama supporters need to ask themselves how they can give that support to someone who spent 20 years in the company of a self-described communist, and an admirer of Sirhan Sirhan?

A final agreement has been reached between African Press International (API) and Fox News Network (USA) on the dates to air the Michelle Obama tape arising from a discussion Mrs. Obama had with the API two weeks ago.  The show will take place any day/time from now, with a 15 minutes alert on when it is to take place.  Other programmes will be interrupted. This is a precaution taken to avoid interference from any quarter.

In the agreement, Fox News Network will broadcast 39 minutes of the 54 minutes long tape.  The whole tape cannot be aired unedited due to security reasons and especially due to the explosive political temperature in the country because of the Presidential elections that is just around the corner, November 4th.

The tape will be aired in two portions by two separate units in the Network.  API’s representative will appear live in one of the shows.

The parties have agreed that the information to be released to the public on the agreement will not include the naming of the units at Fox News Network that will air the tapes in order to avoid outside pressure and influence of any kind before the show has taken place. Nondisclosure of the name of the shows that will air the tapes has become necessary due to pressure from groups interested to block the release of the contents to the public.

Due to a huge interest in the tapes shown by some private individuals, groups belonging to some political camp(s) and persons connected to a section of an intelligence network, it has been decided that the 54 minutes long unedited tape is to be kept outside the United States in safe custody of one of API’s Lawyers based in Ontario, Canada.

The day and time schedules of the broadcast will only be announced 15 minutes before the Show begins in order to avoid attempts to block the Show from airing the tapes.

Any pressure from any outside forces that may want to know the exact day and time schedule of the Show before-hand or any other details in the agreement will get no answers to their requests either from API or Fox News Network.

The decision to have the above information public was a difficult one due to the sensitivity of the case and huge interest against, and for, the release of the contents of the tape for public consumption.

Windy City proposes 'gay'-friendly school Pete Chagnon and Charlie Butts - OneNewsNow - 10/14/2008 6:00:00 AM

A battleground is forming in Chicago over a proposed "gay"-friendly high school for homosexual, lesbian, and transgendered students, or any other students who want to attend. According to reports, taxpayer money would be used to fund the school.

 

 

The school would be called the Pride Campus of Social Justice High School, and plans are under way to possibly open its doors in 2010. Advocates of the school say it is needed in order to combat the bullying, dropout, and depression rate among homosexual students. The Chicago Sun-Times quotes a member of the school's design team who says students at the school would be taught about "gay and lesbian historical figures" so those students "have heroes."

 Laurie Higgins and her group, the Illinois Family Institute, are at the forefront of the fray. "A high school that is dedicated to or centrally focused on homosexuality necessarily requires that public educators have come to some prior conclusions about the nature and morality of homosexuality," she points out. Those are aspects of homosexuality that she says stand "far outside the purview of public educators." (hear audio report)
 
Pro-family advocate Peter LaBarbera of Americans for Truth About Homosexuality [Caution: This website contains graphic images] takes issue with the fact that the school would be run on taxpayer monies. "The taxpayers -- whether they're Christians, Orthodox Jews, Muslims -- they will be funding [this] pro-homosexual indoctrination school for so-called 'gay' youth," he explains.
 
The activist also takes issue with the prospective principal of the school -- 29-year-old Chad Weiden -- who was asked what it would have been like if had had a school like Pride Campus to attend.
 
"...[H]e says quote: 'I would have made progress a lot earlier. I would have had a model of what it meant to be a gay man -- that a gay man could be in a committed relationship, a marriage; could have children. I didn't know that was possible.'
 
"Well, it's not possible," LaBarbera reacts. "Two men cannot produce a child -- and they can't, quote, 'have children.'"
 
Higgins agrees that public funding for the school would be inappropriate. And as for the rationale for the school being needed to combat bullying of homosexual students, she believes rules of conduct should be established and enforced on an equal basis. "The task is to combat harassment and abuse and bullying, while not affirming disordered thinking and immoral behavior," she explains.
 
And while she acknowledges that some homosexual students are bullied, Higgins' experience in public education reveals another group that she feels suffers more. "I can say with assurance that the kids who are very conservative Christians are probably the ones who are the most ridiculed or made fun of," she states.
 
Chicago Public Schools is soliciting public input for a vote. LaBarbera and Higgins both encourage concerned Chicago parents to petition that the school not be allowed to open.

 

 

Recordings and information leading to recent API story on Michelle Obama's telephone call is now being cleared for release.

API is disturbed by the way many have reacted to the story on Mrs Obama’s call. Many have shown us by the way they have behaved towards API that they only think of their own interests because they have demanded that the audio recordings should be released immediately. We understand that the tapes should be released, but those who have demanded the release of the tapes seem not take into account that API may become a suing target.

The Recordings:

API has recordings of the conversation between API and Mrs Obama (Shocking development: Mrs Obama decides enough is enough: “My husband was born in Hawaii and adopted by his step father, does that make him unpatriotic; she asks”, on a direct telephone to API., and we confirm that the audio will be released to the public. In the last 24 hours, API has been consulting legal advisers on the way forward in order to avoid being sued by the Obama camp. API has realised that the contents of the tapes if made public may change the political atmosphere in America for ever, especially in the next few days.

Due to enormous reactions received, API now understands the impact of the statements made by Mrs Obama. The American people have reacted in a way we in API would never have expected.

Many have question why Mrs Obama would choose a little known online media group instead of the American media. API was chosen because of a Nairobi contact that did not like the way API was covering Barack Obama using information collected from American media outlets. The Nairobi contact prevailed upon Mrs Obama to talk to API.

The only thing API may have done wrong is not informing Mrs Obama that the conversation was being recorded. This is why it is taking time to release the recording while consulting a legal team because API wants to be legally safe from any Obama camp law suit.

The US Media Outlets:

Since the release of Mrs Obama story, many US media outlets have insisted that API should release the recordings made when Mrs Obama spoke with API. We understand the importance of the recordings in our possession and yet the first thing we are thinking of is not simply to make them public because groups are pressurising API to do so. The release of the information will be done, because we know we have Mrs Obama on tape, but API must do it in a way that does not put API in an embarrassing legal situation.

Die-hard Obama supporters:

A number of Americans who are die-hard Obama followers have tried their best to intimidate API using all kinds of threatening methods when they call in and when they email us. They are implying that API is planning to destroy Obama’s chances to become the next US President. API does not have a direct interest in the US Presidential elections and we want Obama supporters to understand that. However, when someone who may become the next first lady makes such comments as in the story we have published, the public have the right to know. Intimidation directed to the publishers of the story is not the answer.

The delay to make public the recordings is expected to give time to Mrs Obama to come clean and tell the American people that her comments were not meant to harm anyone  but that she was reacting to the media pressure on her husband. She should also come out and tell the American people that she will not discriminate those who are not Obama fanatics if she becomes the first lady.

Die-hard Mcain supporters:

Those who do not support Obama are actively pushing for the release of the recordings also, and we understand them very well. In many telephone conversations with them we, however, get disturbed when we realise that most of them want the recordings to be released because they want to use it to stop Senator Obama from being elected President. They state clearly that if the story is true and released now, the contents will safe America from a constitutional crisis that may come if things come out after the elections that proves Obama was adopted by a foreigner, thus, disqualifying him from the Presidency.

Some readers:

Some have questioned why API has its base in Norway. Online News Media can be based anywhere in the world. With the Internet age, a news network can have people anywhere in the world. API’s news correspondents - 19 of them are real and based in the African Continent. API is a solid Daily Online News Channel and this Obama story will not change that.

Questioning API on being based in Norway:

There is nothing wrong having African Press International based in Norway and the channel run by Africans from the African Continent. Even Kenya’s present Prime Minister Raila Odinga lived in Norway for some time before joining the Kenya government.

API has also been accused because of the timing to release Mrs Obama story. Some even discus small issues as to why API telephone number starts with 00, and spellings in the article. This to us in API sounds ridiculous.

The important thing to be concerned about is how API obtained the story and how genuine it is. The second thing is to exercise understanding and to respect why there is a delay in releasing the recordings. API is not saying there are no recordings, but it is important to take serious API’s concerns on a possible suit if the tapes are not handled carefully.

API is not out to convince the American public of anything. We do not want to influence the outcome of the US Presidential elections. API got a true story and published it. The fact that the story has caused a stir was unexpected, but that does not mean API must rush in a manner that will cause problems to itself, just to satisfy those who want the audio tapes so badly.

When the legal concerns are cleared, which is happening in a short while, API will make public all the recordings available. This will also include comments, not yet published, which will most certainly put the Obama Campaign spokesperson who had dismissed the story off balance.

Even if our recordings or any other recordings had surfaced after the elections and  if the contents were damaging to the elected person that still could have caused any elected president to vacate the White House. We all know that the tapes released in the US in 1974 forced President Richard Nixon out of office. The truth is the truth. The tapes during Nixon time did not lie.

The same here. The recordings that API will release soon will not lie to the American people. Most probably, it will change the political landscape, something the Americans should start getting prepared to face.
